The business license restaurant owners need from the council

The most important approval is the business license restaurant owners get from their local council, such as DBKL in Kuala Lumpur or MBPJ in Petaling Jaya. It’s usually a composite licence covering both your premises and your signboard.

Councils look closely at food premises. Expect them to check your kitchen layout, ventilation, grease trap, toilets and fire safety, and to inspect the premises before approval. Many will also ask for proof that your staff have completed food handler training and typhoid vaccinations.

Processing usually takes a few weeks for a straightforward application. The licence is generally valid for one year and must be renewed. If you’re in Kuala Lumpur, our DBKL business license guide covers the process in more detail, and our signboard guide explains the sign rules.

Before you sign a tenancy, check that the unit is approved for food use. Not every shop lot can legally host a restaurant kitchen, and that’s a costly thing to find out after the renovation.

Food handler training and typhoid jabs

Under the Food Hygiene Regulations 2009, everyone who handles food must complete food handler training before they start work. This applies to cooks, kitchen helpers and front-of-house staff who serve food, and includes you if you’ll be in the kitchen.

  • Food handler training: a short course of at least three hours with a trainer approved by the Ministry of Health, available online or in person
  • Typhoid vaccination: required for food handlers and usually checked by the council when issuing or renewing your licence

Keep the certificates on file and make sure new staff complete both before their first shift. Health officers can inspect food premises at any time.

Halal, liquor and music licences

Depending on your concept, you may need some extra approvals:

Halal certification

Halal certification is optional, but you can’t claim your food is halal without it. Applications go to JAKIM or your state religious authority, which will inspect your premises and suppliers. A restaurant can’t hold halal certification and serve alcohol at the same time.

Liquor licence

If you plan to serve alcohol, you’ll need a liquor licence from your local licensing board. Expect checks on how close you are to mosques, schools and residential areas, and allow extra time for approval.

Music licences

Playing recorded music or hosting live performances usually requires licences from the relevant music licensing bodies. They’re easy to overlook, so add them to your checklist.

WRT license for restaurant Malaysia foreign owners

If more than 50% of your company is foreign-owned, you’ll also need a WRT license for restaurant Malaysia operations from KPDN. This is the part that most often changes a foreign investor’s plans.

KPDN generally reserves everyday local cafés and non-specialty restaurants for Malaysian businesses. A foreign-owned restaurant usually needs a distinctive, specialty concept, such as an authentic international cuisine, to be considered. On top of that, you’ll need:

  • A Malaysian Sdn Bhd with at least RM1 million in paid-up capital
  • A physical restaurant premises that KPDN can inspect
  • Your menu with prices and details of your head chef
  • A business plan explaining your concept and target customers

A WRT license for restaurant Malaysia applications usually takes a few months, so start early. Our guide on how to apply WRT license for foreigners in Malaysia covers the full process, and our WRT license service can handle it for you.

The order to do things in

Doing things in the right order saves both time and money. For most restaurants, that looks like this:

1. Register your business

Set up your sole proprietorship, partnership or Sdn Bhd with SSM. Foreign owners will need an Sdn Bhd.

2. Check the premises before signing

Confirm the unit is approved for food use and that your concept is allowed at that location.

3. Apply for WRT, if foreign-owned

Inject the capital and apply to KPDN before you commit to a big renovation.

4. Train and vaccinate your team

Book food handler training and typhoid jabs while the renovation is under way.

5. Apply for your council licence

Submit your premise and signboard application, which is the main business license restaurant owners need, then prepare for the inspection.

6. Add halal, liquor or music licences

Apply for any extras that fit your concept, then open your doors.

Good to know: trading before your council licence is approved can lead to fines or your premises being sealed. Build licensing time into your opening date from day one.

Final thoughts

Getting every restaurant license Malaysia requires isn’t difficult, but it does take planning. Start with the premises and your council licence, get your team trained and vaccinated, and sort out WRT early if you have foreign shareholders.
